Securing Your British Citizenship & Passport
Applying for British citizenship through naturalisation represents the crowning milestone of your UK immigration journey. Becoming a British citizen grants you the permanent right of abode, unconditional voting rights, freedom from immigration time limits, and the privilege of holding a British Passport.
Naturalisation is governed by the British Nationality Act 1981. Unlike visa applications where objective criteria dominate, citizenship applications involve statutory discretion exercised by the Home Secretary, notably regarding the stringent Good Character requirement. At Kingdom Legal, our nationality lawyers audit your background meticulously to ensure your petition is granted without complication.
Core Eligibility Requirements for Naturalisation (Form AN)
1. Five-Year Residence Route (Non-Spouse)
- Must have held Indefinite Leave to Remain (ILR) or settled status for at least 12 months.
- Must have been physically in the UK exactly 5 years before the application date.
- Maximum absence allowance: 450 days total over the 5-year period, and no more than 90 days in the final 12 months.
- Knowledge of Language and Life in the UK (Life in the UK test + B1 English qualification).
2. Three-Year Route (Married to a British Citizen - Section 6(2))
- Must hold ILR or settled status on the date of application (the 12-month waiting period is waived).
- Maximum absence allowance: 270 days total over the 3-year period, and no more than 90 days in the final 12 months.
The Home Office examines criminal convictions, driving endorsements (speeding points), bankruptcy, HMRC tax non-compliance, historical immigration breaches (e.g. overstaying or working without permission), and character references. Our senior lawyers prepare detailed legal submissions mitigating minor historical issues to safeguard your application.
